Ravalli County governments

This letter will look at how well our governments are working in Ravalli County, without the party spin, but with hard facts, and hard truths. Some might remember the documentary commissioned and filmed in the Bitterroot Valley in 2009 named “Beneath the Beauty”. Within that 2 hr. production the Mayor of Hamilton, Jerry Steele is asked about incorporation documents for his city, required for public inspection in Montana under MCA 7-2-4100 and following.

The public inspection issue is a problem for our local governments. As many people work for these governments, all of a sudden it has become “all of them” against an individual, or smaller group of people. This newspaper has bravely entered the courts to attempt to warm the heart of Honorable Langton, personally I tried with Honorable Haynes to plead public disclosure of police reports which outweigh personal privacy of an individual, even if they work for a local government. The constitutional right to know is a powerful one in Montana, and our local governments don’t have a terribly good track record if you look at the filing history in the Montana Supreme Court.

In 2006 a person named Prindel sued Ravalli County for not releasing documents, and records the failure to release public information. In 1992 it appeared that the Hamilton City Judge was sexually harassed by the sitting Mayor Whitlock, and a group called Citizens to recall Whitlock sued the Mayor to release the investigation due to public concern of the document. The Bitterroot Star, and others sued the County for the release of Geoff Mahar’s complaint against the Ravalli County for similar reasons.

Why do our local governments behave so badly? It’s due to the “all of us” against the individual mindset. The interesting part is the admission in official meeting of Mayor Steele in August 2009 of no incorporation public documents for the City of Hamilton. The official plat map indicates the City of Hamilton was annexed to Missoula Co. on September 4, 1890, with no record of incorporation since. Ravalli County was created by the Montana Legislature on March 3, 1893 except that Hamilton relies upon a newspaper article from July 21, 1894 as proof of “incorporation”. Neither the current city clerk nor county clerk can find required public documents for Hamilton’s lawful incorporation. How can these local governments lawfully collect taxes or have employees, elections or any function of a government such as courts, law enforcement?

Montana law MCA 7-2-2103 says that a county seat such as Hamilton must be incorporated for a county to lawfully exist. Seeing how the chicken came before the egg for Ravalli County (county created 1893 prior to “incorporation” in 1894 or Marcus Daly founding in 1895) do we wonder why our local governments are behaving so badly? It’s because they don’t lawfully exist, and they don’t need to behave or follow the rules.

Open meeting laws, public disclosure of information, partisan infighting, potential issues with civil rights; all due to no desire to be lawful. If we want less government intrusion, public officials can decide to put their pencils down, and stop collecting our taxes. Seeley Lake is a wonderful place to live, because Missoula Co. leaves them alone. With proof that Missoula Co. owns Hamilton, and Ravalli County cannot exist without a legitimate county seat, it’s time to get out the drawing board and chalk out some lawful solutions for our local governments to exist in the Bitterroot Valley.

Dear Ravalli County Commissioners,

The City of Hamilton does not exist, yet kills motorist Jan 7, 2010:

The Ravalli County Sheriff, who do not know how to uphold rights, have approximately 29 Deputies, more reserve deputies all centered in Hamilton, MT, a city that does not legally exist. Sheriff Hoffman does not uphold our rights:

Then we are blessed to have a NIH lab that studies INFECTIOUS AGENTS which could kill us within a few days that have 15 more Law Enforcement in Hamilton, MT.

Caught at Missoula Airport--50 miles away.

The NIH lab in Hamilton gives out sound emissions that affect your constituents sleep, but you all sleep well as a commissioner told me you receive "training money" to attempt to have volunteer firemen show up for a bio-hazard like Ebola activated by their 1950's air-raid siren. HMMMM.

SO, Commissioners, we have 15 City, 2 Stevensville, 29 County, 3 State Highway, 5 State Game Wardens, 15 Federal Officers who report to Ravalli Co. and Hamilton, MT. That is at minimum 70 officers for 3700 residents of Hamiltion MT, and 37,000 residents of Ravalli County.

TWICE WHAT IS NEEDED.

While it is nice to have a large payroll of "officers" on the side of Government. We have some problems Ravalli Commissioners. One being The City of Hamilton does not legally exist, admitted in official public meeting in 2009. Who stops this situation, or corrects it lawfully? How much attention does one location need? Is 10 Million enough to destroy the economy? It appears so.

Who would come to Montana not knowing where Ravalli County or Hamilton was knowing what is going on here. Who will accept responsibility for the deaths in 2005 in Ravalli County custody?

Sheriff Chris Hoffman's word

Sheriff Chris Hoffman is pretty touchy when it comes to HIS sheriff department in Ravalli County Montana. A budget crunch drew out what appeared to be an ornery, accusatory public official. This post is to look solely at some of Chris Hoffman's comments over the years, and this news source will allow the public to decide what Sheriff Chris Hoffman's word means if anything at all.

On February 13, 2005 a reporter from the New York Times asked Chris Hoffman about the numerous suicides in Ravalli County, which rank his county as #2 in the Nation. Chris Hoffman said that the number surprised him, although Sheriff Hoffman serves as coroner, and signs all death certificates with the cause of death listed. To verrify this statement in print see:

Many residents of Ravalli County, including Sheriff Candidate Vanek that deputies put questionable deaths or some straight forward ones in the suicide category due to ease of investigation.

Four men took their own lives while under the custody of Sheriff Chris Hoffman in 2005.

Ravall County Sheriff Chris Hoffman told the New York Times (link above) that he was not sure he would run for Ravalli County Sheriff in 2005. As Ravalli County residents are aware, Chris Hoffman ran for Sheriff in 2006 and in 2010 after making that statement. The four Ravalli County residents who died reportedly at their own hand were in the custody of Sheriff Chris Hoffman.

The interesting part is Sheriff Chris Hoffman making official comment to Ravalli County Commissioners that his department " who long ago earned the public trust" and something about upholding their sworn oaths to the US and MT Constitutions. Amendment 5 of the US Constitution includes the right to life, something Sheriff Chris Hoffman does not seem to understand the significance.

Ravalli County Sheriff Chris Hoffman told the Montana Public Radio that "...he does not know why he would say that..." referring to Sergeant Fowler telling Judge Haynes (above) that he did not steal the ammunition in the Ravalli County lockup (I call it grand theft ammo). Fowler was set up to fall for the criminal fast fingers within the Ravalli County Sheriff department, and his "trial" was purposely delayed past the 2010 election to not politically upset incumbent Sheriff Chris Hoffman.

Sheriff Chris Hoffman feels his department has earned the trust of the public in Ravalli County. Does that include failure to protect a woman too afraid to sleep in her house due to neighbor threats? Does that include ignoring State law, and a State Officer urging Sheriff Hoffman to cite a fire code offender? That oath is State AND Federal Mr. Hoffman.

Trust in the Ravalli County Sheriff Department means allowing deputies to get in drunken brawls in at UM Grizzly football games in Missoula, allowing porn to be viewed on county computers, computer games by prison guards instead of rounds, allowing law enforcement such as now Chief Ryan Oster into the cell block to encourage the suicides of the four men trusted to Sheriff Hoffmans' care. Ryan Oster was trained by Sheriff Hoffman. Lets look at Chief Oster's adherence to Constitutional Rights in Hamilton, the county seat of Ravalli County:

Trust in the public includes tampering with evidence, a felony in Montana to convict innocent people in Ravalli County Montana. Trust in the public means tampering with the recorded conversation to implicate an innocent person Mr. Hoffman? Trust from the public when Sheriff Hoffman himself said "watch your step in Ravalli County" while two members of the public attempted to assist and ask how to help his Department. Threats dont improve public trust Mr. Hoffman.

The Ravalli County Sheriff department did not catch the two juveniles who hit a staff member and escaped. It was a retired law enforcement who called in, and participated in the apprehension. The Ravalli County Sheriff Department never caught the triple murder in Florence, MT from 2001. Many say that evidence contamination and crime scene contamination were partially to blame, amongst other things. Sheriff Chris Hoffman is very protective, to a fault of his Sheriff Department in Ravalli County. The double standard to the public is what is most problematic about Sheriff Hoffman.

While nobody is perfect, I hold a Commissioners comment of "unprofessional" as true for Sheriff Chris Hoffman. An associate's wife was arrested within days with an outdated warrant, and the specifications on the warrant had already been met. Chris Hoffman had told us that "(he) would check our files" meaning if you intruded into the Ravalli County Sheriff office or offered to help, you would be investigated, and unlawfully arrested--to prove a point: it is a select group of protected people in Ravalli County Montana.

Sheriff Hoffman's under sheriff, McConnell was found to be abusing his wife, then rehired as a deputy. Sheriff Chris Hoffman's choice for under sheriff was an alleged wife abuser, Deputies within the department stole ammunition, and pointed the finger at Fowler.

The bottom line is that Sheriff Chris Hoffman can think he has the trust, and is upholding the oath of office all he wants. There are two sworn affidavits in the Ravalli County Clerk and Recorder Office that say differently. It is one thing to tout your "long ago earned trust" in Ravalli County, it is another thing to actually have a resume and actions to back up those words.

Ravalli County Sheriff treat the public as if we are idiots. We know the truth about Sheriff Chris Hoffman. We have seen and experienced the truth about Sheriff Chris Hoffman in Ravalli County Montana. His words mean nothing, unless you are on the other end of a telephone as he is cussing you under his breath and calling you the biggest scum and everything else imaginable. I was issued a national security clearance up until Mr Hoffmans deputies decided to tamper with evidence, and Mr. Corn decided to let a law student prosecute without supervision in violation of a court order.

I will believe Mr. Hoffman when there is rule of law in Ravalli County Montana. I will believe Mr. Hoffman when he stops being so protective of OUR sheriff department in Ravalli County. I will start believing Mr. Hoffman when he halts the crime WITHIN the Ravalli County Sheriff Department.

I will start believing Mr. Hoffman's word when his deputies uphold my rights and allow basic protections like free speech, peaceful assembly, and equal protection in Ravalli County Montana.

I will believe Mr. Hoffman when he follows his own word: sending 1 maybe 2 Deputies for a civil service (Certified Letter authored by Sheriff Hoffman dated February 1, 2011). Four were sent to my house, and $200 damage was done to my entry door on November 4-6, 2009 as no one was home. That is definitely how Mr Hoffman has earned my trust: by giving false statements in a certified letter from the Ravalli County Sheriff Department.

There were two witnesses to Sheriff Hoffmans deputies on my property on November 4, 2009 one Deputy was the one who watched porn, and tampered with evidence. Do the Ravalli County Commissioners need more information that Chris Hoffman's word means nothing? Does the public in Ravalli County want to listen to Sheriff Chris Hoffman calling a Ravalli County Commissioner a "bully"?

The real bully is Sheriff Chris Hoffman. Proven.

Chris Hoffman's word means nothing. He said he was not sure he was going to run in 2005 and graced us in 2006 and 2010. Sheriff Hoffman fails to protect us, and is filling the papers in Ravalli County with hot air double speak. It takes a man like Sheriff Hoffman to cover for a criminal department like the Ravalli County Sheriff Department.

Sheriff Chris Hoffman's words are being judged in a place where they are not protected. Judgment should come soon on how well he upholds the Constitution. I already know.

He has definitely earned my trust, and Brad Palin, and Ryan Heath, and Scott Lewis, and Mark Wilson. And everyone else in Ravalli County.

Equal Protection

In an article in today's Bitterroot Star, a member of the public is seen sitting peacefully on public property in Hamilton, Montana:

Did this man have his employer intimidated, did this man have a call to dispatch that he was harassing county employees? If the Ravalli County Commissioners were so much into the Constitution, then equal protection and due process would dictate equal treatment of all Ravalli County Residents.

Why this disparity? Article II section 4 of the Montana Constitution covers individual dignity and due process of law. Why is this man allowed to sit peacefully and not be put on the front page of the Ravalli Republic as criminal trespass? Instead this man is put on the front of a Bitterroot Valley Newspaper as a member of a rally with no law enforcement in sight.

Hamilton's Judge Michael Reardon feels that this protected activity is criminal. The voting public has no choice but to elect Judge Reardon in Hamilton Montana due to no one running against him in 2011. Beware of sitting on public property in Hamilton, Montana: you have no constitutional rights upheld by the City of Hamilton, nor from Sheriff Chris Hoffman and his deputies [this is not personal blame, its the training and learned culture].

Two police officers in Fullerton, California are being charged for violating a man's constitutional right to life, and was murdered by law enforcement. What's the difference between the right to life and the right to peacefully assemble?

I have NOT had Good Experiences with John Muhlfeld - John Muhlfield of River Design Group

My Experience with John Muhlfeld is that he ruins lives. I have witnessed John Muhlfeld of River Design Group speak of hiring who he wants on those big tax dollar projects to restore streams, even though for the "public" and to be within the boundaries of the law John Muhlfeld would advertise for these jobs. John Muhlfeld said this in front of FWP and many other witnesses.

I have witnessed the stream restoration projects that John Muhlfeld of River Design Group was in charge of, rip out ever year due to shoddy work, as John Muhlfeld simply gets more grant money, tax payer dollars to hire his friends to do the same bad job. Also during this project John Muhlfeld disrespected our right to private property. John Muhlfeld let his dogs run thru our house and garage, John Muhlfeld left our livestock gates open and John Muhlfeld had total disrespect as John Muhlfeld acted above the property own and in CHARGE of their property simply because a stream ran thru it.

John Muhlfeld, In my experience is not an honest man, John Muhlfeld is not a man of honor and integrity and John Muhlfeld now running for the Mayor of Whitifish Montana has sparked me to speak out again about my experience with John Muhlfeld of the River Design Group and to post ALL tips I get On John Muhlfeld.

I have had calls and emails over the last 5 years about John Muhlfeld and I have simply kept quiet. Though the Grave Creek Resoration project that John Muhlfeld worked on affected my life personally and affected Montana Taxpayers Immensley.

Since Hamilton Montana is a "special project" and we pay our MAYOR $17,000 US why are we hearing from Dennis Stranger all the time? Where is Jerry Steele?
Dennis Stranger is telling the city council (which he is not a member) not to invest in treasuries, that those funds are HIS to spend on "special projects". Do we need a justice center when we employ 14-15 police officers when the unincorporated "city" needs FOUR (4) police officers? Didnt we just build a public works building and a bathroom at River Park?

Speaking of special projects, will it take a rocket scientist to repair the embankment at River park coordined off for the past two years. All of the public works directors I worked with knew how to complete the work: 1) 310 permit, 2) Corps. of Engineers approval, 3) place fill, 4) compact with equipment at low water 5) place rip rap [Project cost: less then $75,000]
Dennis Stanger solution: hire consultants to ponder project for [$150,000] get nothing done for 2 yrs.
Why do City employees get a 1.6% raise as state employees and county employees are frozen in salary (and laying off people)? Do unions have figurative guns to our officials heads?

Bitteroot Bully #3: Justice of the Peace James Bailey
Ah yes, the Judge who allowed Angela Wetzsteon to commit a criminal act in a Ravalli County Courtroom August 8, 2007, who issued an arrest warrant unlawfully, and made sworn affidavit Ms. Wetzsteon was a "State's Attorney" in the summer of 2007, when graduation happened in 2008. The Judge who allowed discovery deadlines to be broken, and allowed tampered evidence in his courtroom.

Judge Bailey of Ravalli County Judiciary (Justice Court) has no clue a Writ is a discretion of a higher court, not a credible threat to the Ravalli County Commissioners. To the current commissioners: to save money, please consolidate Justice Court to ONE (1) judge. You all will have to flip a coin as to who will go, although Robin Clute is ten times more dangerous in her "thinking" about the law then JP Bailey. Clute has no wing-man now that "Corn dont grow" in the 'Ravalli County Courthouse'.

Threats are a way of life in the Bitterroot Valley, then you get accused of them when they dont happen, say on the lawn of a Library at high Noon. Pat Groninger has taken over Stevensville (again); Dennis Stranger has completely taken over and overcharges Hamilton residents $1.6M (pay up). JP Bailey is dumb enough to threaten the County Commissioners with a court proceding (PS he's in deeper doo-doo for his own constitutional violations).

Cutting budget items is tough, unless someone is stupid enough to threaten the person with the authority to cut budgets. Ravalli County Commissioners need to figure out that "Justice Brings Prosperity" and 3,000 citations mean too many law enforcement officers are on the streets in Ravalli County. Liability comes when these officers violate rights (it really is not their fault if they are not properly trained). Sheriff Chris Hoffman with 57 mills for public safety constantly whines for money, then brings liability with officers who contribute nothing more than civil liability.

Bitteroot Bullies suck. Dennis Stranger bullied up a story in November 2009, Pat Groninger took over a city where he faced a recall election and resigned (Bitterroot Star info). JP Bailey is attempting to stand up for the Ravalli County Judiciary, yet is attempting (not so well) to bully the Ravalli County Commissioners.

So, Americans....is this how you will allow your governments to treat you? By Bullying?

I give all respect to Ravalli County Commissioners in this budget process.
My Recommendations to end bullying & balance the Budget:
1) Cut, and train the remaining officers in all aspects of appropiate conduct, civil liberties
2) less Citations mean less court personnel (read www.RobinClute.com)
3) Read and google "Creating Jobs Montana" online

City of Hamilton:
1) Find Mayor Steele
2) Kick Dennis Stranger off City Council, place on employment probation
3) return the $1.6 Surplus to the citizens of Hamilton Montana
4) Auction off Police cars, equipment not needed beyond FOUR (4) police officers.
5) Hire a new police chief, actually acting chief, because that person will be a beat cop too.

Bitterroot Bullies should not get what they want.
Citizens deserve freedom to live their lives without fear of local government.

Economic Freedom
Economic freedom is based on a simple moral rule: everyone has a right to his or life and property, and no one has the right (including City of Hamilton, Montana) to deprive anyone of these things.

complaint, Smith alleged that I had violated Montana law by illegally
lobbying the Legislature without having been registered as a lobbyist
with the CPP.

I responded that I was merely exercising my First Amendment rights to
speak to legislators and to you. Montana law requires people to
register as lobbyists if they are paid to influence the Legislature

(as Smith is). Since I am paid nothing, I told the CPP, everything I
do in Helena is a protected exercise of free speech.

After two years + of investigating this complaint, the CPP has
finally dismissed the complaint, saying that it cannot find that I
did anything wrong or in violation of the lobbying laws.

Now, the question remains, what about Smith and his false
complaint? Has he broken any law about filing false complaints with
a government agency? Has he committed slander with the intent to
damage my reputation? Certainly, Smith's complaint against me was
widely reported in the media at the time, but the media has been dead
silent on the CPP dismissal of the complaint. Is it any wonder that
I feel that Smith's snit has damaged my reputation? He certainly has
done nothing to personally attempt to repair any damage he may have
done, such as offer an up-front public apology.

Why did Smith file the complaint in the first place you ask? Here is
my best guess. Smith had held out to the MSPOA (for whom he IS a
paid lobbyist) that MSSA's landmark self defense bill, HB 228, was a
dragon in need of slaying, and that only Smith could slay it, even
though there really wasn't much in the bill that affected sheriffs
departments. However, Smith really wanted to use the political
influence of MSOPA against our self defense bill, because Smith is
personally very anti-gun, unlike most sheriffs. At the time Smith
was on the steering committee of Montana's only anti-gun group,
formed by a handful of Missoula radicals and called the Montanans
Against Gun Violence, a group that regurgitates the anti-gun rhetoric
of the Brady Center.

Meanwhile, the sheriffs hoped to get some relief in the 2009
legislative session for the medical costs of prisoners in county
jails. Smith neglected and failed on that issue, squandered MSPOA's

political capital and offended many legislators with his personal
anti-gun political agenda, opposing MSSA's self defense bill.

In explaining his multiple failures to MSPOA, Smith's only excuse was
that he was forced to play on an un-level playing field because Gary
Marbut was lobbying for MSSA without being properly registered with
the CPP. To emphasize this lame excuse to the MSPOA, Smith filed the
complaint against me with the CPP. At least, that's how I read the tea
leaves.

Now that the CPP has dismissed the complaint, I hope Smith feels as
foolish as he looks. Now that the Sword of Damocles no longer hangs
over me, it hangs over Smith. He can wonder if there is a criminal
case in the pipeline for him for false reporting, or if there is a
fat civil case heading his way for slander. We are definitely
researching those options.

Sorry if this sounds like a rant to you, my many friends and
supporters. It has been very stressful to me to have a governmental
agency sicced on me, and having possible sanctions pending for over
two years, all for doing your business in Helena as a
volunteer. Thanks for your continued support of MSSA.

" Recent Murders Spur Protest Against Domestic Violence"

"It has taken Sarah Peters one year, but she’s speaking up. Her mission, she says, is to shine more light on the dark world of domestic violence.

Peters, 27, was 16 years old when she married Justin Calbick, who is currently being held in the Flathead County jail and accused of shooting his brother, Stacey Calbick, 38, and father, Donald Calbick, 60, on Jan. 27, 2010.

On the anniversary of the shootings, Peters and several of her friends stood outside the Flathead County Justice Center holding signs with messages about domestic violence prevention.

Peters said she would like to draw more attention to the matter so no one would have to go through what she did a year ago.

On Jan. 13, 2010, Calbick was arrested and charged with raping and assaulting Peters. Bond was originally set at $50,000 by the District Court, but the Justice Court released him on his own recognizance.

Peters said she went through all the recommended steps to protect herself, including filing a temporary restraining order and going to a safe-house.

But on Jan. 28, 2010, the Flathead County Sheriff’s Department received a 1 a.m. call reporting that Calbick was at his wife’s home armed with a rifle and had bound several people with duct tape.

Court records say Calbick bound the hands and feet of three adults, including Peters, for three hours. There were also three children at the residence. The hostages were able to convince Calbick to turn over the rifle and let his wife’s friend go on the premise that she would not contact authorities.

The woman’s husband called 911 when she got home and responding officers found Calbick sitting on the couch unarmed and arrested him without incident.

It was only later that she learned about Donald and Stacey, Peters said, and she believes they died trying to stop Calbick from going to her house.

Donald, who Peters said was as close as a father, had said he would keep Calbick away from her, she said.

“Dad and Stacey died trying to save us and that wasn’t their job,” Peters said.

What spurred her to speak out, she said, were the Christmas Day murders of Jaimi Hurlburt,35, and her daughter, Alyssa Burkett, 15.

The suspect in the case, Tyler Miller, was Hurlburt’s ex-boyfriend and had allegedly made threats against her life in the days before the shooting.

Upon reading about the shootings in the newspaper, Peters said it was time to stop being a victim and start being an advocate.

She contends that the system that is supposed to protect victims of domestic violence is not working.

“This did not have to happen,” Peters said as she held her sign in the chilly weather.

“It was completely preventable

and now it’s completely not-repairable.”

“They didn’t learn from Justin,” she added.
“They need to start protecting us.”

But Flathead County Sheriff Chuck Curry said that while officers want to help to the best of their ability, there are limits to what authorities are allowed to do when it comes to locking someone up.

“We of course take domestic violence very seriously and will continue to,” Curry said. “We will continue to do our part within the system.”

Curry said authorities have made strides in the past couple of years to combat domestic violence, and the Sheriff’s Office deals with thousands of these cases every year.

“If you look at our numbers, we deal with these cases every day,” Curry said.

Domestic violence cases are often very complicated when authorities are dealing with them, he said, but they seem simpler when a tragedy occurs, such as the Christmas Day murders.

“In hindsight, they’re all black and white,” Curry said.

Peters said she would like to see changes within the justice system when it comes to domestic violence, which would include certain parts of state law.

Calbick appeared for a hearing in District Court on Jan. 28, where his attorney scheduled a Feb. 3 hearing at which Calbick intends on changing his not-guilty plea.

Peters, who attended the hearing, said she would keep speaking up.

“We teach people how to treat us by what is allowable,” Peters said. “If nobody talks, nothing’s going to change.”

I have now gone into legal proceedings with the City of Libby three times, and have won every time.

It amazes me how all of the heated rhetoric changes when people raise their right hand and promise to tell the truth, the whole truth, and nothing but the truth.

I don’t believe we should be forced to go to court to get to the truth of government dealings.

On the witness stand testifying for the Clerk, the Mayor didn’t accuse me of attacking the City Clerk like he did in his letter to the editor.

The Mayors’ testimony was dominated by his inability to recall almost any pertinent facts of the issue at hand.

In fact, we proved in court that his Clerk threatened an elected official.

My honor is intact.

Now, I haven’t put myself, and my family, at risk of harm just for the fun of it.

I haven’t spent tens of thousands of dollars just to defend my honor. Just so we are clear on this, the next time I go to court with the City I am going to take a TON of your money when I walk out.

I have taken these measures to protect your best interests
and attempt to ensure this doesn’t happen to anyone ever again.

We now have momentum to change the predatory policies that have harmed this community for far too long. I am going to devote the remainder of my term in office trying to affect policy that will ensure no one is ever abused by City government again.

The Judge said this was a “horrible Personnel issue”, I think that the Personnel Committee is a good place to start.

The people of Libby have to help, there is political power only in numbers.

The idea of putting cameras on Mineral Avenue was only put to rest because of the crowd in the audience. If the people of Libby truly want to direct their own destiny, they have to show up.

I am not without compassion for the City Clerk and the issue of her legal fees. I am also cognizant of the fact that half of those fees were for her personal time and effort and would have gone in her own pocket. I think there is a way out of this that would be agreeable to most everyone involved.

Since this half-literate, red-necked ditch digger walked into court and faced the City Clerk and her high paid attorney, the Mayor of Libby, and the Head of Personnel (and Personal Assistant to the County Commissioners), and whipped them all, maybe Attorney Todd Glazier should just refund her fees.

Sir,

I write to you with respect, admiration and hope. In this time of our nation’s strife, I do not ask for monetary relief or a bailout. Sir, I have lost everything that I hold precious in life, I live in Ravalli County, Montana. There are no civil rights here, there is no justice here, and there is no one to appeal to. I want my human rights, and my freedom back.

I am 67 years old, I was raised in the Navy, and served in the USCG for four years, I served 25 years in the Seattle Fire Department where I retired on 9/11/91. I have served my country my entire life and I still abide by the oath’s that I swore to defend my Flag, the President, and to serve the American People, as did my Father.

Sir, I moved to Ravalli County, Montana in April of 2002. After 911 I wanted to try and start over as I felt that my time of usefulness had passed. Fate works in strange ways and my duty as an American was to be tested like never before. I found myself in the midst of ignorance, racism, hate crimes, nepotism, and corruption, where the weapon of choice for criminals is the American Flag.

I fight for America Sir, and now the rumble has reached the White House. The horses hitched to your wagon have brought you into it. The truth shall set us free.

I present to you the “unbelievable” daily life of American citizens in the Ravalli Territory, the Holy Grail of injustice in America:

Montana is the third largest state in the lower 48, yet has a population of less than one million residents. It has three electoral votes with one Congressman and two Senators. There are 56 counties distributing the power of the United States Constitution.

The present Governor of Montana states that “Montana is for Montanans”, and openly mocks the government of the United States. I am an American, not a Montanan.

Ravalli County starts at the Idaho border to the South, runs the length of the Bitterroot river, with the Bitterroot Mountains to the West, and the Sapphires to the East. There is one road, Highway 93, in or out. No news goes out and very little comes in as we have no Newspaper, and one radio station. It is isolated and remote.

The County Government is the cow that feeds it. It offers jobs to those who are willing to buy in. All others are treated as “illegal aliens”.

The County Attorney is an all powerful entity, above the laws of the United States, openly protected by the State and our National Representatives. Ravalli is a micro climate set up to set the standard for the rest of the state. It can be compared to a “black hole”. Seventy percent of Ravalli County is Federal land. This is a Third World Country within the State of Montana. No person or entity can, or will claim jurisdiction here. Is this the template for the new America?

Very few people in this state go unaffected or untouched by these events of violation.

The last Census said there were approx 37,000 residents, of which 29,000 are of voting age. Amazingly all of them are “registered voters”. The Secretary of State claims to have very little control over voting laws in the county. They are defined by the County Attorney as to who shall , or shall not vote, and what they may, or may not petition.

The County Sheriff is an elected official and is the head Law Enforcement Officer in the County. There is no criteria to be the Sheriff.

The current Sheriff received a unanimous vote of “no confidence”, from his department and yet was re-elected. Any group will only be as good as it’s leadership.

There are five elected County Commissioners, all paid.

They have no say over the County Atty (CA) , or Sheriff. The CA regularly overrules any legislation they try to pass regarding zoning or permitting. They are pretty much powerless, with main emphasis on who shall sit on county boards.

The City of Hamilton is the County seat. There are less than 4,000 people living within the city. They have 6 city council seats, an all powerful Mayor, a city Judge, and a Justice of the peace, all of whom are elected. There is no City Treasurer although the citizens passed a petition to have a Treasurer.

The words “and to the Republic”, mouthed by these officials during the “Pledge of Allegiance”, refers to the local newspaper.

The City Attorney, works under contract, also acting as prosecutor. This attorney worked for almost 6 years without a contract, and never swore an oath of office at any time.

This is a blatant violation of State Law.

His comment about that is, “ it is ridiculous to think that I should have to swear an oath”.

The State bar, and the District Court Judge, said it was ok to violate state law and swear the oath 6 years later. The Court system prides itself on very tough justice with a 90 percent conviction rate of violators of the law. All judges and city attorneys are former prosecutors for the County.

Hamilton Police Department has a force of fifteen officers.

A normal town has one officer per thousand population. They have the run of the County as their jurisdiction. They have been out of control for a very long time. The “tail wags the dog” here. They are almost all of “local flavor”.

The Police Chief acts with impunity to any authority including, county, state and federal.

The City of Hamilton is not incorporated.

City limits were never established; no census of the population was ever taken, and there was no election held by those citizens to establish the “City of Hamilton”. Therefore, what is the legal standard and criteria by which this illegal group administers, executes and prosecutes the laws of the State and Constitution of the United States.

How can they issue permits and tax the people?

How can they be allowed to hold elections for a nonexistent entity?

The County Attorney claims he has no authority in issues within the city of Hamilton. People within Hamilton may not vote on county issues by order of the County Atty. The Sec of State has no record of Hamilton, Montana therefore no controls regarding voting.

The Fire Department claimed by Hamilton is an all volunteer group of 20 Fire Fighters, none of which are paid. Their services are minimal, and there is no standard or criteria as to qualification or training. They are an entity separate from the city.

They are the First Responders to the NIH Rocky Mountain Lab a level four biolab. There is no way these men should be expected to cover this facility. RML gives a grant to the HVFD to buy a 100 foot Aerial Platform, surely the most useless piece of equipment they could have. There is no one who knows how to drive it, and no where to park it. There are no buildings over 3 stories in the county or city.

The Fire Chief quotes to me, “we need the Aerial Ladder so there are no ground ladders up when the walls collapse”. There are no paid fire fighters anywhere in the county that I know of.

NIH has put science before the safety of American Citizens.

This county would be an excellent place to move Guantanmo. There is no escape, no rights and no one to complain to.

However, the rest of the world might regard it as “cruel and unusual punishment”.

In 2001 three women are killed in a Florence, MT beauty salon in broad daylight, The case remains unsolved.

In 2002 a Hamilton officer shoots and kills a man involving a domestic dispute. Six months later a coroners (a former Hamilton City Police Officer, and current Sheriff) inquest finds it justifiable.

In 2002,the State loses it’s viable Power Company which was publicly owned. Jobs, pensions and a public utility all are shuffled and sold. This was considered business as usual here with no investigation by the State or federal government.

In October of 2005, a man has barricaded himself in a gas station convenience store at the edge of town after briefly holding the employees hostage. His white pickup truck, a second male passenger, and a large white bag on the ground are left in a driveway around a corner from where the man has fled.

The owner of the home asks the remaining man if he is ok and the man says, “yes, but my buddy is really messed up“.

He walks around the corner and watches with the Police.

Quite a while later the home owner watches a third man pick up the bag on the ground, toss it into the truck and drive off.

Law enforcement from all over Western Montana have surrounded the station, blocked off the highway, and wait for over 9 hours before attempting to enter. The Hamilton Police chief is in charge of the scene.

They find the man has killed himself in the bathroom. He has a briefcase containing $4000 dollars he had robbed up in Flathead County. The News Media had covered the episode from the earliest minutes and report a sad but successful end to the story. Law enforcement are commended for their good work.

There is no mention of the second man or the money. Two days later, the Ravalli County Sheriff’s dept shows up at a residence at the end of a road about 10 miles out of town and wants to know where the missing $200,000.00 from the robbery is?

The residents are dumbfounded to learn that the truck used in the robbery has turned up abandoned on their property. No mention of this has ever been made public that I know of. The witness where the truck originally stopped is advised by a state official to keep her mouth shut.

Within a six month period in 2005, five inmates hang themselves in the Ravalli County Jail. A coroner’s inquest finds everything ok.

What could cause such desperation of these men, to take their own lives. Who were they?

What had they done? There was never a trial or question of who and why.

Death at the hands of law enforcement
is taken for granted as “normal” in Montana.

Several jail employee witnesses are terminated.

There are survivors who lost their loved ones, fathers, sons, and friends. There are those that know the truth and must live with it. There are those that must cover up the truth further enlarging the ripple and the quicksand trap it feeds.

The Police chief retires from the City dept to take a job with the NIH Rocky Mountain lab. The lab turns down very qualified people for administrative and security positions keying for what they describe as “local flavor”.

They hire the City Administrator, along with the Police Chief. The closest professional help for any emergency is in Missoula, at the least, 90 minutes away. The same campus in Bethesda, MD has a 30 man fire department covering their lab.

The 20 Hamilton Volunteers are neither trained or qualified to address any part of an emergency within this facility and should not be asked to do so. Certified letters sent to Bethesda regarding this situation have disappeared. NIH security is often seen patrolling the streets of the city.

The District Court Judge for Ravalli County is pulled over by Hamilton Police and charged with DUI.

He is ticketed and booked. His story is spread all over the “Ravalli Republic”. He is pulled over again in Missoula and charged with the same thing. He admits to a problem, says he will go through the rehabilitation and is allowed to keep his position. The Officer doing the initial arrest will be referred to as “not so super“, Notso.

The officer often testifies to the Judge, along with the Hamilton City atty who doesn’t think the Oath of office means anything. The Montana Disciplinary Committee, aka Bar Assn, says “no problem”. This man had once been a respected and trusted Judge, now his opening line must be “How may I please the state”?

The local daily newspaper, the Ravalli Republic is owned by Lee Enterprises. It is totally controlled by the County attorney here, and all of it‘s other publications will only print the party line. Falsehoods causing much grief to innocent people are regularly published, yet retractions and other viewpoints are staunchly avoided.

Any innuendo that something is foul in Montana is rewarded with a “fuzzy bunny” story as the County Attorney, and other State Officials reminisce of happy times in their rise to success . Made up “awards” and plaques are given with accolades to Police Officers, and their leaders for their “humanitarian” work.

There are few, if any newspapers in Montana which are not owned by Lee. I would liken it to Pravda.

A retired Army Veteran is parked in front of his Physical Therapist office in the middle of downtown Hamilton in the afternoon.

He is waiting for his appointment time. He looks up to see a gun pointed at him in the drivers side window. There are three more Hamilton Police officers in position with guns pointed , demanding he get out of the car.

He gets out and is braced and searched. He finds out that he is suspected of being a terrorist shooter because he is wearing a leather vest. He is told to watch his step.

In 1949, I recall having a butterscotch sundae with Mr Watling, at NAS Niagara where my father was stationed. He was a Navy jet pilot and he was leaving for Korea. I don’t remember what we talked about except that he had noticed my “cub scout hat”, and that he seemed pleased to be with me.

I can never forget the respect, that my father showed him at our introduction. The newsreels at the movies were never the same when I found out that he wasn’t coming back. I was probably his last memory of America. I learned early the responsibility of my heritage.

A young HPD Officer is appointed by the unincorporated Hamilton City Council to be the new Police Chief in spite of pressure by community leaders to get an outside professional for the position. The force now numbers 15.

A normal city will have one officer per 1,000. Hamilton has less than 4,000 residents. On any given night the town lights up like the Aurora Borealis with blue lights flying everywhere. It appears that the tickets are the towns only income. One rookie officer sets the record with over 100 unsupervised arrests and is applauded for his wonderful work.

At the end of his year probation, he swears the ” oath of office”. He regularly holds “show and tell” with other citizens showing the actual videos of his arrests with commentary about the victims. These officers carry real guns with real ammunition, they are brandished regularly.

Sir, with your connections, could you get Supercop, a few days of duty on the streets of Chicago? Better yet, let’s just swap departments for about a week.

A retired decorated LA Police Officer, who was disabled after being run down by a murder suspect lives here. He is a former United States Marine who has served abroad, and willing community volunteer. He joins up with members of the USMC Band who are performing at the County Fair. He attempts to give some of them a ride, when after pulling out of his parking place, he is pulled over by “Supercop”.

He is accused of cutting in front of the police car and DUI. Supercop gives the “Mic on, Mic off”, routine to the flustered veteran, and writes him a serious DUI ticket. The Vet is devastated and seeks counsel outside of Ravalli County.

The attorney urges him to plead “per se” and take the consequences, as he says the “police there, will lie”. The Vet does as urged and has the book thrown at him by the Hamilton judge who is a former Marine adjutant proud of the harsh sentencing handed out in Hamilton.

He is devastated and embarrassed. He goes to his health club, and there Supercop and others openly and publicly mock him.

The man resigns from the health club and has to see a shrink to get his health and composure back. The Vetcop is pulled over months later for DWIH (Driving While In Hamilton), and the officer immediately goes to the mans license tabs where he finds that the “numbers don’t match”; amazing police work.

This place is a vipers nest where honest, good people are not welcome and openly discriminated against. Like all of us, he is wounded and will never be the same. He has lost his faith in America.

Is this the greeting returning vets shall receive? Is this what we all served for? Is this the legacy for our children?

A Native American man is shot and killed in Darby by the town Marshal. The Marshal has been notorious for ticketing a very famous late night talk show host and for anally tight law in his town, which is referred to as “camera land”.

Fines are payable then and there.

He responds alone to a domestic dispute and gives a pat story the night of the shooting . It was portrayed that he had responded to the place and was immediately jumped by the man, whom he knew well. While fighting to keep his gun away from the man, he shot him twice.

This was all over the news that night and the next day. When relatives showed up, they found the girlfriend was under arrest in the hospital, and there was reportedly another witness.

The Marshal was wired for tape.

Six months later, during a Coroner’s inquest, a new version of the story unfolds where the witnesses could not remember anything , and parts of the tape are blank. The last words you hear are the Marshal stating that he was going to shoot the man, and then he does. The death is found justifiable.

I ski in the winter and often ride the chair with students up for the day. One young man is always dressed in dark blue and never without a ski mask on. I have talked to him several times and learn he is a home school student from Darby.

One day he tells me that it is his birthday and that he just got an assault rifle with a stainless steel barrel that wont wear out. He wants a pair of twin tip skis like mine so he can ski backwards and shoot.

“I am very seldom at a loss for words”.

While serving in the USCG, I spent a year of isolated duty on an island in the Aleutians. After a while you lose the perspective that there really is anything outside of where you are. People who have been in combat or taken long sea voyages will give you the same comparison.

Hostages tend to accept and sympathize with their captors and go along with it as a survival instinct. You do whatever it takes to fit in. I believe it is called “Stockholm Syndrome”. It is a very necessary trait one should have to live in Montana. ""
